The Commission will hold a hearing beginning on 23 April 2013 at 9 a.m. at the Conference Centre, Phase IV, 140 Promenade du Portage, Gatineau, Quebec to consider the applications described below.

This notice calls for comments on issues significant to Canadian television viewers and the Canadian broadcasting system, such as the composition and affordability of the digital basic television service, as well as the renewal of licences for several independent conventional, pay and specialty television services.

The issues that will be considered by the Commission in this hearing have been categorised in three main sections:

  • First, the Commission will examine a number of applications by new and existing programming services for the mandatory distribution of their services as part of the basic service of all Canadian cable and satellite providers.
  • Second, the Commission will examine applications by existing programming services that are currently distributed on a mandatory basis as part of the basic service of all Canadian cable and satellite providers. The Commission will assess whether these services should continue to benefit from such distribution, as well as examine the overall renewal of these licences.
  • Thirdly, the Commission will examine the renewal applications of a number of independent conventional, pay and specialty television services. The Commission will focus solely on the renewal of the licences for these programming services as they have not requested any form of mandatory distribution on a cable or satellite provider’s basic service.

The three sections of this notice of consultation are further broken down and explained below.

Introduction to sections 1 and 2: What is mandatory distribution of its service on the digital basic service?

When Canadians buy a package of digital television services from their cable company or satellite distributor (i.e. a broadcasting distribution undertaking or BDU), there are certain channels (or programming services) that automatically come with the package. A few of these channels are mandated by the Commission to be part of every Canadian’s basic service package pursuant to section 9 (1)(h) of the Broadcasting Act (the Act). When requiring the mandatory distribution of these services, the Commission may also set a minimum rate that must be paid by the BDU to the service provider to distribute this service. The rate is a monthly fee, based on the number of subscribers receiving the service. Because part of these fees for these channels are reflected on Canadians’ monthly cable or satellite bills and because part of these fees are remitted to the operators of these channels by the BDUs, the Commission requires the distribution of these channels only in exceptional circumstances where the channels fulfill important policy objectives under the Act. Currently, the following services have mandatory distribution on the basic service at the following per subscriber monthly wholesale rates:

  • CBC News Network (in French-language markets): $0.15
  • Réseau de l’information (RDI) (in English-language markets): $0.10
  • Avis de recherche (in French-language markets): $0.06
  • Weather Network/Météomedia: $0.23
  • TVA: offered without a wholesale rate
  • Aboriginal Peoples Television Network (APTN): $0.25
  • Cable Public Affairs Channel (CPAC): $0.10
  • AMI audio, formerly known as VoicePrint: $0.04
  • Accessible Media: $0.20
  • Canal M, formerly known as La Magnétothèque: $0.02

The Commission notes that in this proceeding it is not examining the renewal of the mandatory distribution orders for TVA, the Weather Network/Météomedia, RDI and CBC NewsNetwork. The mandatory distribution order for TVA was examined and left in place in TVA Group Inc. – Licence renewals, Broadcasting Decision CRTC 2012-242, 26 April 2012, and the Weather Network/Météomedia’s mandatory distribution order does not expire until 31 August 2018. As for RDI and CBC NewsNetwork, the Commission recently examined the renewal of their mandatory distribution orders during the November 2012 public hearing at which it considered the licence renewal of the Canadian Broadcasting Corporation’s (CBC) French- and English-language services. The Commission has not yet published its determinations with respect to the CBC licences and renewal of the distribution orders.

The Commission has the authority under section 9(1)(h) of the Act to “require any licensee who is authorized to carry on a distribution undertaking to carry, on such terms and conditions as the Commission deems appropriate, programming services specified by the Commission.” Since section 9(1)(h) allows the Commission to require carriage of programming services “on such terms and conditions as [it] deems appropriate,” mandatory distribution can take different forms, including:

  • a “must-offer” status – in other words, the cable or satellite operator must make this service available to subscribers, who can then choose whether or not to subscribe to the service;
  • mandatory distribution in certain regions of the country; and
  • national distribution on the basic television service of all BDUs.

In the latter two cases, subscribers to cable and satellite providers cannot opt out from receiving and, if a monthly wholesale rate is prescribed, paying for these channels.

Criteria for assessing applications for mandatory distribution on the digital basic service

As noted above, there are number ways in which the Commission can require the distribution of a programming service, the most prescriptive being mandatory distribution of its service on the digital basic television service of all BDUs. It is for this reason that the Commission has established specific criteria to deal with this type of distribution.

In Criteria for assessing applications for mandatory distribution of its service on the digital basic service, Broadcasting Regulatory Policy CRTC 2010-629, 27 August 2010 (the Policy), the Commission set out a new approach for evaluating applications for mandatory distribution on the digital basic service pursuant to section 9(1)(h) of the Act. This new approach is based on specific criteria which were established in order to allow the Commission to determine whether a programming service:

  • makes an exceptional contribution to Canadian expression and reflects Canadian attitudes, opinions, ideas, values and artistic creativity;
  • contributes, in an exceptional manner, to the overall objectives for the digital basic service and specifically contributes to one or more objectives of the Act, such as Canadian identity and cultural sovereignty; ethno-cultural diversity, including the special place of Aboriginal peoples in Canadian society; service to and the reflection and portrayal of persons with disabilities; or linguistic duality, including improved service to official language minority communities; and
  • makes exceptional commitments to original, first-run Canadian programming in terms of exhibition and expenditures.

How could these applications affect Canadians?

Adding or removing any service to or from a basic television service package may affect the price of this package since part of these channels’ fees is reflected on monthly cable and satellite bills. Moreover, as noted above, mandatory distribution of programming services may constrain Canadians’ choices over which services they receive. Therefore the Commission carefully weighs the impact these services will have on Canadians, both culturally and financially, against the benefits provided by their programming and the contribution they make towards meeting the objectives of the Act.

The programming services that have applied for mandatory distribution

As part of this process, the Commission will be examining 22 applications by programming services that have requested the mandatory distribution of their services as part of the basic television service of BDUs. These include applications from new services, existing services that do not have mandatory distribution and services seeking to renew their mandatory distribution status, as follows:

Unless otherwise specified, the Commission notes that the licensees and applicants requesting a mandatory distribution order pursuant to section 9(1)(h) of the Act applied for national mandatory terrestrial and direct-to-home distribution on the digital basic service.

Introduction to section 3: Licence renewal applications of independent conventional, pay and specialty television services

Section 3 of this notice contains the licence renewal applications of independent pay and specialty programming services as well as the applications of the independent conventional television stations whose licences expire on 31 August 2013. As part of its examination of these applications, the Commission will consider the licensees’ various requests with respect to their regulatory requirements (e.g. conditions of licence, local programming requirements, Canadian programming expenditures, etc.), address potential non-compliance issues and determine the length of the licensees’ next licence term. The Commission notes that it may decide to issue licence terms of varying lengths depending on a number of factors, including the requests made by the applicant and potential non-compliance issues.

The applications set out in section 3 are organized into the following groups:

3 a) Licence renewal applications of independent pay and specialty Category A services

Pay and specialty Category A services offer programming in a particular genre and are protected from direct competition from other Canadian and non-Canadian programming undertakings. These services must generally be made available to consumers by all authorized distribution undertakings and then offered to subscribers in various packages based on terms and conditions negotiated between BDUs and the programming services.

3 b) Licence renewal applications of independent specialty Category B services

Specialty Category B services offer programming in a particular genre and can be in direct competition with other Category B services or non-Canadian services but not in direct competition with Category A services. Category B services are not necessarily made available by all BDUs as their distribution is secured through terms and conditions negotiated between BDUs and the programming services.

3 c) Licence renewal applications of independent conventional television services

Conventional television services offer all genres of programming and are distributed by distribution undertakings on the basic cable package in their respective local markets as well as being available to Canadians as free over-the-air signals.

3 d) Licence renewal applications of independent conventional and specialty television services that wish to operate under the same terms and conditions

One Category A pay service and a number of Category B specialty services have indicated in their licence renewal applications that they wish to operate their services without any changes to their licences.

How to participate in this public process

The Commission invites detailed comments on the applications listed below by 20 February 2013.

Appearance of parties at the public hearing

New or continued mandatory distribution of services on the digital basic service pursuant to section 9(1)(h) of the Act will likely have an impact on Canadians and on the Canadian broadcasting system in general. With this in mind, the Commission intends to consider the applications listed in sections 1 and 2 of this notice during the appearing phase of the hearing.

Similarly, because of the impact of independent pay and specialty Category A services within the Canadian broadcasting system, the Commission also currently intends to consider the renewal applications listed in section 3a) of this notice during the appearing phase of the hearing.

Subject to interventions, the Commission currently intends to consider the licence renewal applications listed in sections 3 b), 3 c) and 3 d) of this notice without the appearance of the parties at the public hearing. Nevertheless, the Commission may request some of these licensees to appear during the appearing phase of the hearing to address issues of apparent non-compliance.

The programming is devoted exclusively to the broadcast of live and recorded coverage of the proceedings of Nunavut and the Northwest Territories in Aboriginal languages, as well as English and French.

Application by Canadian Punjabi Network Inc. for a broadcasting licence to operate a national ethnic third-language specialty Category B service to be known as Canadian Punjabi Network (CPN).

The applicant is also applying for mandatory distribution of its service on the digital basic service of all broadcasting distribution undertakings serving areas where more than 5,000 Punjabi speakers reside, pursuant to an order issued under section 9(1)(h) of the Broadcasting Act.

The applicant states that the programming of this general-interest service will be primarily in the Punjabi language and will focus on the realities of the Canadian Punjabi community, with a high percentage of programs made in Canada. It will offer news originating from several cities, talk shows, women’s programs, sports, documentaries and musical and dramatic entertainment. CPN may use English and French in programs teaching those languages to Punjabi speakers and in occasional interviews (less than 10% of the schedule) and may use Hindi (less than 20% of the schedule) in musical programming and Bollywood Entertainment.

CPN will exhibit 70% Canadian content over the day, and 80% between 6 p.m. and 11 p.m., averaged on an annual basis.

The applicant states that the programming will initially consist primarily of feature films and television series, but will also offer a broad array of programming across all genres, including niche programming, in the future.

The applicant proposes to offer programming from all program categories set out in item 6 of Schedule I to the Pay Television Regulations, 1990, as amended from time to time.

The applicant has confirmed that it will adhere to the standard conditions of licence for video-on-demand undertakings set out in Standard requirements for video-on-demand undertakings, Broadcasting Regulatory Policy CRTC 2011-59, 11 January 2011 and Standard requirements for video-on-demand undertakings – Provision of an outlet for local expression, measures to control the loudness of commercial messages and annual filing of aggregate statistical data, Broadcasting Regulatory Policy CRTC 2011-59-1, 8 May 2012, with the exception of an increased requirement for Canadian programming other than feature films and increased contributions to the Canada Media Fund.

The applicant states that all of the programming will consist of open-format described video programming so as to provide access to a wide breadth of news, information, drama, entertainment and other television programming to Canadians who are blind or partially sighted.

The applicant proposes to offer programming from the following program categories set out in item 6 of Schedule I to the Specialty Services Regulations, 1990, as amended from time to time: 1, 2(a), 2(b), 3, 4, 5(a), 5(b), 6(a), 6(b), 7(a), 7(b), 7(c), 7(d), 7(e), 7(f), 7(g), 8(a), 8(b), 8(c), 9, 10, 11(a), 11(b), 12, 13 and 14.

The applicant is also applying for mandatory distribution of its service on the digital basic service pursuant to an order issued under section 9(1)(h) of the Broadcasting Act.

The applicant states that the programming will be entirely devoted to Canadian movies, particularly feature films intended for theatrical release, and will include Canadian feature films, Canadian feature documentaries, Canadian made-for-TV movies and programs with or about Canadian filmmakers. All feature films intended for theatrical distribution will be presented without commercial interruption.

The applicant proposes to offer programming from the following program categories set out in item 6 of Schedule I to the Specialty Services Regulations, 1990, as amended from time to time: 2(a), 2(b), 5(b), 7(c), 7(d), 7(e), 12, 13 and 15.

The applicant has confirmed that if it is granted mandatory distribution, it will adhere to the standard conditions of licence for specialty Category A services set out in Standard conditions of licence, expectations and encouragements for specialty and pay television Category A services, Broadcasting Regulatory Policy CRTC 2011-443, 27 July 2011.

Deadline for interventions or answers

20 February 2013

The new Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure, SOR/2010-277 (the Rules of Procedure), set out, among other things, the rules for content, format, filing and service of interventions and answers of respondents, the procedure for filing confidential information and requesting its disclosure, and the conduct of the public hearing. Accordingly, the procedure set out below must be read in conjunction with the Rules of Procedure and its accompanying documents, which can be found on the Commission’s website under “CRTC Rules of Practice and Procedure.”

An intervention or an answer from a respondent must be filed with the Commission and served on the applicant on or before the above-mentioned date. An answer from a respondent must also be served on any other respondent.

In accordance with the Rules of Procedure, a document must be filed with, not merely sent to, the Commission by 5 p.m. Vancouver time (8 p.m. Ottawa time) on the date it is due. The Commission takes no responsibility for postal delays and will not notify a party whose submission is received after the deadline date. Late submissions will not be considered by the Commission and will not be made part of the public file.

The intervention or answer must include one of the following statements in either the first or the last paragraph:

  1. I request to appear at the public hearing.
  2. I do not want to appear at the public hearing.

The applicant, respondents and interveners are permitted to coordinate, organize and file, in a single submission, interventions of other interested persons who share their position but do not wish to appear at the hearing as a “Joint Supporting Intervention.” More information on how to do so and a template for the covering letter to be filed by the parties can be found in Changes to certain practices for filing interventions – Expansion of filing practices to include the filing of joint supporting comments for broadcasting policy proceedings, Broadcasting Information Bulletin CRTC 2010-28-1, 10 December 2010.

Interventions and answers will be considered by the Commission and will form part of the public record of the proceeding without further notification to parties, provided the procedures set out in the Rules of Procedure and this notice have been followed. Parties will be contacted only if their submissions raise procedural questions.

Submissions must be filed by sending them to the Secretary General of the Commission by only one of the following means:

A true copy of each intervention or answer from a respondent must be sent to the applicant and, in the case of a respondent to an application, to any other respondent.

The Commission advises those who file and serve by electronic mode to exercise caution when using e-mail for service of documents, as it may be difficult to establish that service has occurred.

Parties must ensure that, before initiating service through electronic mode, they will be able to satisfy the Commission, upon request, that service was completed. The sender must keep proof of the sending and the receipt of the document for 180 days after the day on which it is filed.

Submissions longer than five pages should include a summary.

Each paragraph of the submission should be numbered. In addition, where the intervention is filed by electronic means, the line ***End of document*** should be entered following the last paragraph of the document, as an indication that the document has not been altered during electronic transmission.

Interventions and answers must clearly identify the application referred to and indicate whether parties support or oppose the application, or, if they propose changes to it, include the facts and grounds for their proposal.

In the event that an application/an application to be considered during the non-appearing phase of the hearing is brought to the oral phase of the hearing, and if parties wish to appear, they must provide reasons why their written interventions or answers are not sufficient and why an appearance is necessary. Parties requiring communication support must state their request on the first page of their intervention. Only those parties whose requests to appear have been granted will be contacted by the Commission and invited to appear at the public hearing.

Persons requiring communications support such as assistance listening devices and sign language interpretation are requested to inform the Commission at least twenty (20) days before the commencement of the public hearing so that the necessary arrangements can be made.

Important notice

All information that parties provide as part of this public process, except information designated confidential, whether sent by postal mail, facsimile, e-mail or through the Commission’s website at www.crtc.gc.ca, becomes part of a publicly accessible file and will be posted on the Commission’s website. This information includes personal information, such as full names, e-mail addresses, postal/street addresses, telephone and facsimile numbers, and any other personal information parties provide.

The personal information that parties provide will be used and may be disclosed for the purpose for which the information was obtained or compiled by the Commission, or for a use consistent with that purpose.

Documents received electronically or otherwise will be put on the Commission’s website in their entirety exactly as received, including any personal information contained therein, in the official language and format in which they are received. Documents not received electronically will be available in PDF format.

The information that parties provide to the Commission as part of this public process is entered into an unsearchable database dedicated to this specific public process. This database is accessible only from the web page of this particular public process. As a result, a general search of the Commission’s website with the help of either its own search engine or a third-party search engine will not provide access to the information that was provided as part of this public process.

The Commission encourages parties and interested persons to monitor the record of the proceeding, available on the Commission’s website, for additional information that they may find useful when preparing their submissions.
